Objetivos
The course aims to provide students with an advanced and critical understanding of the role of business actors in the contemporary international human rights framework. It seeks to equip participants with the conceptual, legal and practical tools necessary to analyse, assess and address corporate human rights impacts in a globalised economy.
Specifically, upon successful completion of the course, students will be able to:
Understand the historical evolution and normative foundations of the Business and Human Rights (BHR) field, including its anchoring in international human rights law, international labour law and environmental law.
Critically analyse the UN Guiding Principles on Business and Human Rights (UNGPs), their three-pillar structure, and their legal and practical implications for States, corporations and affected communities.
Examine emerging regulatory frameworks at international, regional and domestic levels, with particular attention to the European Union (e.g. CSDDD, CSRD, Sustainable Finance framework) and ongoing negotiations on a binding international instrument.
Assess corporate human rights due diligence as a governance tool, including its scope, methodologies, limitations and enforcement challenges across global value chains.
Analyse access to remedy mechanisms for victims of corporate human rights abuses, including judicial, non-judicial, grievance and hybrid mechanisms.
Engage with contemporary debates on sustainability, climate change, extractive industries, digitalisation and conflict-affected contexts through a BHR lens.
Develop the ability to apply BHR standards to concrete case studies, policy scenarios and regulatory design, combining legal reasoning with ethical and socio-political analysis.
Competencias
Students completing the course will acquire the following general competences:
Advanced analytical capacity to interpret and critically assess international and regional legal instruments related to business and human rights.
Ability to integrate interdisciplinary perspectives (law, political economy, sustainability, ethics) in the analysis of corporate conduct and human rights impacts.
Capacity to identify, evaluate and compare different regulatory and governance approaches to corporate accountability at global and regional levels.
Practical skills to analyse corporate policies, due diligence processes and sustainability reports from a human rights perspective.
Ability to formulate coherent, well-structured and evidence-based legal and policy arguments, both orally and in writing, in an international academic environment.
Enhanced critical thinking regarding power asymmetries in global value chains and their implications for human rights protection.
Capacity for autonomous learning and collaborative work in multicultural and multidisciplinary settings.
